Eligibility and accounts
You must be capable of forming a binding contract under applicable law. If you create an account, you are responsible for safeguarding credentials and for activity under your account. Notify us promptly at support@cinamate.com of unauthorized use.
Licence and acceptable use
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for their intended purpose. You must not:
- Violate law or third-party rights
- Upload malware or attempt to probe, scan, or breach security
- Scrape, reverse engineer, or interfere with the Services except as permitted by law
- Misrepresent your identity or affiliation
- Use the Services to spam, harass, or distribute unlawful content
Your content
You retain ownership of content you submit (“User Content”). You grant Cinamate a worldwide, non-exclusive licence to host, process, display, and otherwise use User Content solely to operate and improve the Services and as otherwise agreed in a separate customer agreement. You represent you have all rights needed to grant this licence and that User Content does not infringe others’ rights.
Our IP
The Services, including software, branding, and documentation, are owned by Cinamate or its licensors and protected by IP laws. No rights are granted except as expressly stated.
Copyright complaints
If you believe content on the Services infringes your copyright, send a notice to copyright@cinamate.com with: (a) your contact information; (b) description of the work; (c) location of the material; (d) a statement of good-faith belief; (e) a statement under penalty of perjury that the information is accurate and you are authorized; and (f) your physical or electronic signature. We may remove content and, where appropriate, terminate repeat infringers.
Third-party services
The Services may integrate third-party tools. Their terms and privacy policies apply to your use of those tools.
Fees
Paid features are billed as described at purchase or in an order form. Unless stated otherwise, fees are non-refundable except as required by law. Billing questions: billing@cinamate.com.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CINAMATE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CINAMATE AND ITS DIRECTORS, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICES WILL NOT EXCEED THE GREATER OF CAD $100 OR THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations; those limitations apply only to the extent permitted.
Indemnity
You will indemnify and hold harmless Cinamate and its directors, officers, and agents from claims arising out of your User Content or your misuse of the Services, except to the extent caused by our gross negligence or wilful misconduct.
Suspension and termination
We may suspend or terminate access for breach of these Terms, risk to the Services or others, or non-payment. You may stop using the Services at any time. Provisions that by nature should survive will survive.
Privacy

Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Exclusive courts: Toronto, Ontario, unless mandatory consumer protections require otherwise.
Changes
We may modify these Terms by posting an updated version. Continued use after the effective date constitutes acceptance, except where acceptance must be affirmative by law.
